Job Advert Summary




To provide support to Group Legal Services with the effective and efficient provision of legal advice to the Rand Water Group in various spheres of law relevant to Rand Water.

Minimum Requirements



Matric / Grade 12. Bachelor of Laws (LLB) / BProc. Admission as an Attorney is highly recommended. Postgraduate qualification is recommended. Must have a minimum of 3 (three) to 8 (eight) years of experience in an in-house role of a leading organization dealing with the duties outlined above Valid driver's license.

Desirable:



+ Must have strong litigation experience and is able to assist Rand Water with litigation management and management of external stakeholders such as external law firms.
+ Must have experience advising on transaction on construction matters, cross-border transactions, and financial sector regulatory framework, conducting due diligence exercise, negotiation, drafting and execution of documents forming part of the transactions.
+ Strong knowledge and understanding of Public-Private Partnerships.
+ Must have experience of providing advice on public sector procurement law, specifically advising on areas such as PPPFA, PFMA etc.
+ Must be able to negotiable, draft and vet contracts in the areas of general contract, cross-border transactions, preparations of particular conditions of contracts for FIDIC contracts e.t.c

Primary Duties



Manage and execute on all legal instructions allocated as and when required. Provide strategic legal support, advice, guidance and provide direction to the Rand Water Group Management of litigation/arbitration for and on behalf of Rand Water and liaise with internal stakeholders and be able to assist with development of best litigation strategies to be adopted for each matter and being able to formulate legal strategies in resolving litigation Develop and implement legal strategies in support of Rand Water's strategy and growth pillars. Assessment of business needs and provide operational advice regarding contracting, projects implementation and assistance with operational support for the entire Rand Water Group. Provide legal support to different committees which may be constituted subject to business needs such as providing support to Bid Committees, etc. Preparing of memoranda, contracts, opinions, and other legal documents. Ability to liaise external stakeholder such as appointed law firms in handling of litigation. Ability to advise the organisation on prospects of success of each litigation, negotiate settlement of matters and advise on the best settlement terms as and when required. Prepare instructions to external attorneys promptly and accurately and ensure that instructions are timeously given to the external law firms. Conduct legal research and advise the organisation on the best and available legal strategies in line with the new, relevant, and correct legal principles. Provide legal training to different business units on applicable legal issues which is relevant for a particular business unit; Review and provide comments on bills, draft regulations, instruction notes and any other legal instruments which may have an impact on Rand Water Group. Any other instruction of commercial and non-commercial nature based on Rand Water's business needs.

Knowledge



Litigation Public-Private Partnerships Cross-border transactions. Construction & Engineering Law focusing on FIDIC, NEC, JBCC, GCC as well as CIDB legislation Strong knowledge of public sector procurement laws such as PFMA, PPPFA and relevant instruction, practice notes as well as case law; Strong understanding of Constitutional, Administrative Law, PAJA, PAIA & POPIA; Understanding of Tax Laws, i.e VAT & Income Tax; Litigation Management; Intellectual Property Law Computer literacy in MS PowerPoint, Office, Outlook and Excel Customer and stakeholder management; Ability to represent the organisation at different forums such as internal committees i.e bid committees, Decision making, Planning and organising, Effective communication People management, Self-management, Conceptual thought and well developed analytical and coordinating skills, Problem-solving Leadership.
