Duties and Responsibilities
Co-ordinate and manage the legal process regarding the enforcement of the Company Collective Agreements in the region.
Manage claims instituted against an establishment as a result of legal action.
Prepare case files for hearings, attends conciliation and arbitration hearings, and presents Company case ensure that the collective agreement is maintained.
Attend to interpleader proceedings and represent Company at CCMA and Labour Court
Manages quality control of legal activities in a region.
Liaise and communicate with external legal service providers.
Assist with any other function as required.
Filing Variation Applications where Commissioners errors occur on Arbitration Awards
Interpretation of Awards
Opposing Rescission Applications and filing notices with the DRC
Verifying and withdrawing finalized cases in legal process
Referring unpaid Settlement Agreement as per Section 142 process / negotiating and finalizing administrative
Compile and draft heads of arguments and applications
Compile legal recommendation for Regional Council Board meetings.
Supervise the Legal Admin Support staff.
Attend to demarcation cases.
Compile and submit month reports.
Draft internal legal opinions
Knowledge Experience and skills
Ability to interpret and apply / enforce the Company agreements
Above average verbal and written communication and listening skills
Ability to build strong effective relationships with all stakeholders, i.e. existing clients and potential clients as well as internal stakeholders, i.e. colleagues and management
Good decision making and problem solving skills
Good analytical skills with attention to detail
Strong negotiation and report writing skills.
Excellent administration, organizational and planning skills
Qualifications and experience
4 year Law Degree (ESSENTIAL)
Must be an Admitted Attorney (ESSENTIAL)
A minimum of 2 years experience in the field of Labour Law AND knowledge specifically with regards to Bargaining Councils and collective agreements is ESSENTIAL.
Sound knowledge or and experience of dispute resolution processes.
Knowledge of the civil procedure essential
Valid Drivers License.
Computer literacy (Word & Excel)
