JOB SPECIFICATION

Position: Legal Counsel

Location: NBCPSS Head Office - Midrand

Job Purpose:

To administer legal, regulatory and compliance processes of the NBCPSS.

Minimum Qualifications and Experience:

  • LLB degree or equivalent qualification
  • Admission as an Attorney or Advocate in South Africa
  • At least 8 - 10 years' experience in labour law (excluding years of articles/
pupilship)
  • At least 5 years' practical experience in litigation
  • At least 5 years' Public Entity experience
  • Experience in dealing with Department of Employment and Labour practices,
Bargaining Councils, CCMA, Labour Court with appearance at the Labour Appeal

Court & High Court being advantageous.
  • In possession of a current valid driver's license and own reliable vehicle.
Duties & Responsibilities
  • Develop, implement, and manage legal strategies for the Council.
  • Establish an effective reporting system regarding legal and risk matters.
  • Development and implementation of legal policies and frameworks

  • To draft and review legal communication and documentation including but not
limited to litigation, affidavits, review applications, contracts, SLAs etc.
  • Conducting and processing of all litigation processes from inception to
conclusion.
  • Overseeing the Exemptions and Appeals processes.
  • To oversee, manage and monitor the enforcement process once arbitration
awards reach Legal Department and onwards.
  • To assist with arbitrations when required in consultation with
relevant parties.
  • Handling rescission applications
  • Responsible to oversee, manage and attend to compliance review applications
in Labour Court.
  • To liaise and communicate with external legal service providers and
to collaborate with other legal professionals.
  • Interpretation of relevant legislation and provision of legal opinions.
  • To provide continuous feedback to all internal parties to ensure
alignment on legal matters.
  • To build, manage and maintain good internal and external relationships.
  • Advising and consulting with regards to all legal matters in the Council
  • Representation of Council in all legal proceedings
  • Instituting Risk Management strategies
  • Managing of staff in legal department
  • Compilation and submission of all legal statistical reporting
  • Proactively staying abreast of legislative changes, national and international
best practice, and ensuring the Council has overall legislative compliance.
