Our client, a well-known South African company in the financial services industry is looking for a Legal & Compliance Manager in Durban, South Africa, to support senior management for the legal & compliance functions in the implementation of the group legal & compliance strategies.

Requirements:

  • Legal Degree (LLB)
  • Admitted as a Legal Practitioner with the Legal Practice Council
  • Sound & in-depth knowledge & understanding of the Insurance Act, Policy Protection Rules, FAIS, COFI, TCF, NCA, POPIA, CPA, & all regulations & guidance notes relating to the preceding legislation
  • 6 years' post qualification experience of which 2 years was in a legal & compliance managerial role within the financial services industry
  • Contract drafting
  • Compliance Management Certificate and/or Certification as a Compliance Practitioner / CPrac (SA)
  • Good understanding of other financial sector laws & regulations
  • Member of the Compliance Institute of South Africa (CISA)
Key Performance Areas:
  • Review & sign-off legal documentation as prepared internally or externally
  • Maintain & review all contract templates to align with regulatory changes
  • Provide guidance on the proper application & interpretation of laws & regulations
  • Establish & maintain effective legal processes
  • Establish & maintain a contract management system
  • Coordinate the engagement of external legal counsel
  • Provision of legal advice to management & staff in all areas of the company's activities & in proffering solutions to legal problems, constraints, risks, options, consequences, & approaches
  • Representing the group internally & externally in negotiation, disputes, consultations, & other proceedings that require legal representation
  • Provide support to management in maintaining a sound compliance culture in the company through the achievement of established compliance deliverables
  • Develop & maintain updated compliance risk management plans
  • Participation in the drafting & implementation of compliance frameworks, policies, manuals, & technical guidelines
  • Ensure that compliance risks are appropriately monitored & managed
  • Conduct compliance monitoring & reporting obligations pursuant to various governing legislations
  • Establish & maintain training programmes in compliance with governing legislations
  • Maintain relationships with regulatory bodies & assist with the handling of complaints
