Role Purpose

The role purpose involves collaboratively managing conflicts and dispute resolution. This encompasses a range of functions, both within the enterprise and beyond, which the internship aims to instill and develop.
Requirements

  • Bachelor of Law Degree or related.
  • Legal Knowledge: A solid understanding of fundamental legal concepts, principles, and procedures relevant to the specific area of law they will be working in.
  • Technology Proficiency: Familiarity with research databases, and Microsoft Office Suite.
Duties & Responsibilities

External Responsibilities
  • External dispute resolution will involve assisting in the complete handling of disputes referred to the CCMA, Department of Labour, private arbitration and litigation in the Labour Court and the Human Rights Court.
  • Handling of disputes referred to the CCMA:
  • Receive and acknowledge 7.11 referrals.
  • Assist in dealing with all preliminary matters/jurisdictional points in terms of the CCMA Rules such as con-arb objections, oppositions to condonation application; applications for senior commissioner; objection to same commissioner.
  • Attend conciliations and receive the certificate of outcome.
  • Receive and acknowledge 7.13 referrals (Application for Arbitration).
  • Provide assistance with the following: preparing heads of argument and filing jurisdictional points, subpoena witnesses, briefing witnesses, conducting pretrial conference, preparing cases, preparing closing arguments and interlocutory procedures such as rescission applications.
  • Handling of disputes referred to the Labour Court:
  • Assist in reviewing applications in terms of Rule 7A of the Rules of the Labour Court, including the filing of notice of review and all ancillary documents.
  • Assist in filing urgent applications to set aside writ of execution, including the filing of notice of motion, and founding affidavit and urgent application.
  • Assist in the extension of time limits and condonation, postponements, and rescission applications.
  • Provide assistance in dealing with collective bargaining.
Internal Responsibilities
  • Assist in direct consultation with management and employees.
  • Assist in negotiations and mediation of internal disputes where appropriate.
  • Assist in advising on and facilitating grievance procedures including receiving grievance forms, facilitating grievance process, and filing all documentation.
  • Assist in advising on and facilitating disciplinary procedures including assessing preliminary findings, facilitating disciplinary process, filing documentation, and drafting of relevant documents (notice of enquiry and sanction letters).
  • Assist in presenting Industrial relations training, including fair judgement, building first line relationships and induction talk.
  • Assist in publishing of monthly newsletter on contemporary labour relations and labour law issues on the MMH website.
  • Assist in the compilation of contracts: including settlement agreements, retrenchment agreements and employment contract addendums to existing contracts.
  • Assist in drafting and updating of company policies in line with contemporary labour legislation.
  • Assist in management of restructures, mergers, take-overs, transfers of going concerns, and retrenchments.
  • Attend and provide support to HCBPxe2x80x99s in informal counselling sessions.
  • Assist in conducting requested workshops.
  • Providing advice and conducting consultation meetings.
  • Grievance procedure assistance:
  • Provide advice on any general query regarding the grievance procedure.
  • Attend and provide input at first stage of the grievance procedure.
  • Examining or amending a completed grievance form.
  • Provide advice on further steps in the grievance procedure.
  • Disciplinary procedure assistance:
  • Advise on any general query regarding the disciplinary procedure.
  • Assisting in the formulation of the notice of enquiry
  • Drafting the notice of enquiry
  • Conducting a preliminary enquiry
  • Advice on procedures
  • Attending disciplinary enquiries and supporting the chairperson, initiator and HCBP.
