Based at the Bedfordview Head Office reporting to the Chief Financial Officer, the Commercial Manager role is to lead and manage the commercial, contract administration and project risk/opportunity functions for the Murray & Roberts Power, Industrial & Water Platform.

Key Performance Indicators:

• Assist with and manage relevant disputes.
• Commercial compliance with all Company policies and procedures.
• To digitally transform the commercial function by designing and implementing 'best in class' commercial procedures, methodologies and systems that are simple, standardised and automated where appropriate, and to continuously improve these systems.
• To implement a standardised performance management system, automated as far as possible, to provide timely and appropriate project reporting covering the commercial and project controls elements of projects.
• To lead, manage and provide support to Project Managers with respect to the commercial & project controls elements of project management, thereby ensuring commercial and project excellence on all projects.
• To lead, manage and provide guidance to Commercial staff with respect to the commercial control elements of project management, thereby ensuring commercial and project excellence on all projects.

Key Responsibilities

1. Develop the functional strategy and execution plan for the Commercial department, which is aligned with the MRPIW strategy.

2. Take responsibility for all commercial aspects of the Business Platform.

3. Provide commercial support to sites from award to final accounts stage; assist in ensuring that contractual opportunities, entitlements and obligations are being recognised and managed correctly.

4. Preparation and negotiation of Joint Venture, Consortium, and Subcontract agreements where necessary

5. Deliver commercial excellence through the development and implementation of simple, standardised and automated (where appropriate) commercial procedures and systems in the following areas:

• Contract and subcontract administration;
• Contractual entitlement including the variations, claims, compensation events, site instructions etc.;
• Change management;
• Measure.
• Project risk/opportunity management.

6. Ensure that contracts and subcontracts are negotiated on sound contractual and financial terms in line with the Murray & Roberts principals of contracting, minimising risk to MRPIW and maximising opportunity as far as possible.

7. Support the development of tenders through commercial and contractual reviews to understand risks so that new contracts are negotiated on terms acceptable to MRPIW.

8. Provide leadership, management, support and guidance to project managers and other project disciplines, regarding the:

5.1 Formulation, valuation and close out of variations, claims, compensation events and site instructions to maximise commercial entitlement and cash flow;

5.2 Commercial and contacts management functions with the ultimate objective of adding value to the business;

5.3 Maximization of cash flow on projects. Ensure applications are submitted timeously, certifications are maximised, invoicing is accurate and timely, cash is collected when contractually due and subcontractors' entitlements are executed in accordance with their contracts

5.4 Implementation and maintenance of all project planning requirements, business system and information management controls as necessary for the effective operation of the business and projects.

9. Monitor the overall risk/opportunity management at project level to ensure the effective mitigation of risks and delivery of opportunities. Ensure timely reporting of project risk/opportunities to the Platform.

10.Remain up to date on all legislation within the construction industry

Minimum requirements

Experience:

• At least 6 years' experience working in a commercial department within the engineering and/or construction industry
• Large project experience.
• Renewable experience will be an advantage.

Qualifications:

• Relevant qualification of either Bachelors' degree in Commercial, Business, Legal in related fields
