Legal Advisor

An exciting opportunity is available for a qualified and experienced admitted attorney to join TFG Africaxe2x80x99s legal team as a legal advisor.

The successful candidate will be required to provide legal advice and services (some specialist) to TFGxe2x80x99s service and retail divisions.

Key responsibilities will include:

  • Drafting, negotiating and settling local and international supply and service agreements
  • Providing ongoing advice and assistance to business regarding contract terms, enforcement and implementation
  • Ongoing legal advice to business to ensure compliance with applicable legislation (including POPIA, CPA and GDPR)
  • Dispute resolution including advising and assisting business with the resolution of escalated customer and ombud complaints
  • Briefing and managing external attorneys for any outsourced matters and facilitating the conduct of those matters
  • Drafting and updating customer-facing terms and conditions and other documents
You must be:
  • an admitted attorney with a minimum of 5 years post admission experience at a top tier law firm or as an inhouse legal advisor at a large corporate
  • able to build good relationships and effectively communicate with stakeholders across all levels of the business as well as third party attorneys, legal advisors and service providers while maintaining objectivity and always acting in the best interest of TFG
  • a critical and analytical thinker with a strong research ability
  • solution orientated
  • able to work in a team or independently, under pressure in a demanding environment
  • forward thinking and business minded while remaining objective
You must have:
  • a LLB Degree
  • current practical experience drafting, negotiating and settling agreements (local and cross border)
  • experience providing legal advice as a practising attorney or inhouse
Highly advantageous would be
  • Eperience reviewing and drafting insurance-related documents, such as 3rd party insurance policies, advertisements, sales scripts, regulated policies and procedures such as complaints and claims management frameworks, training material and various commercial agreements, including, but not limited to agreements with insurance underwriters and third party insurance service providers; interpreting and implementing insurance legislation; liaising with the ombudsman, including the FAIS Ombud, OSTI and OLTI and relevant regulators; a sound working knowledge and experience in the interpretation and application of the Insurance Act, FAIS Act, TCF, Long-Term and Short-Term Insurance Acts, FIC Act, Financial Sector Regulation Act, subordinate legislation such as the Policyholder Protection Rules, FAIS Code of Conduct, conduct standards and board notices and legislation in draft such as the COFI Bill and / or
  • Experience drafting, reviewing and advising on IT service agreements, IT hardware supply agreements, software agreements, end-user license agreements, data processing agreements
Competencies
  • Expert knowledge of and practical experience in the interpretation and application of POPIA, GDPR and CPA
  • Expert knowledge of the SA legislative landscape, common law, contract and delict
  • Exceptional drafting and communication skills
  • Attention to detail and negotiating skills
  • Sound judgement, prioritising and decision making ability
  • Computer literacy and proficiency in Microsoft Word and Office
Preference will be given, but not limited to, candidates from designated groups in terms of the Employment Equity Act.
