Our aim is to provide a work environment where knowledge workers can accelerate the development of their ideas and bring innovation to market, at the same time provide compelling career and development proposition that will enable them to realise their dreams.Position overviewAs the Head of Legal, Risk & Compliance of Sanlam Rewards & Loyalty, you will be responsible for developing and implementing comprehensive data privacy programs, negotiating, and finalising partner agreements, and managing risk within the Coalition reward program. Your role will involve ensuring compliance with relevant data privacy regulations, mitigating risks associated with data handling, and fostering strong partnerships with key stakeholders.If you can demonstrate the ability to promote responsible data practices and set a positive example for other organisations within the industry and have experience in establishing the Coalition as a leader in data privacy through proactive initiatives and collaborations, this would be a bonus outcome.What will you do?Data Privacy:

  • Develop and implement a comprehensive data privacy program: This includes GDPR, Popia and other relevant regulations. This program should encompass data collection, storage, usage, and security practices.
  • Ensure all partner agreements comply with data privacy regulations: Partner negotiations should address data ownership, sharing, and deletion procedures.
  • Conduct regular data privacy audits and risk assessments: Identify and mitigate potential data privacy risks within the program.
  • Implement robust data security measures: Protect sensitive data with strong encryption, access controls, and incident response plans.
  • Provide data privacy training for all program staff and partners: Raise awareness and understanding of data privacy regulations and best practices.
Contracting and Partner Negotiations:
  • Negotiate and finalise comprehensive program agreements with partners: These agreements should clearly define roles, responsibilities, and expectations related to data privacy, legal compliance, and risk management.
  • Secure favourable terms for the Coalition in all agreements: Ensure agreements protect the Coalition's interests and align with its objectives.
  • Develop standard contract templates for efficient negotiation: Streamline the negotiation process while maintaining key protections.
  • Build strong relationships with key partners: Foster collaborative partnerships based on trust and mutual understanding.
  • Continuously monitor and update agreements as needed: Adapt agreements to reflect changes in regulations, program evolution, and partner dynamics.
Risk Management:
  • Data privacy breach: This includes accidental or unauthorised access, use, disclosure, alteration, or destruction of personal data. This could lead to significant financial penalties, reputational damage, and legal action.
  • Non-compliance with data privacy regulations: Failure to follow relevant regulations could result in hefty fines, investigations, and even business interruption.
  • Ineffective partner agreements: Weakly drafted or inadequate agreements could expose the Coalition to unnecessary risks, liabilities, and challenges in data ownership, usage, and dispute resolution.
  • Unfavourable contracting outcomes: Losing leverage in negotiation or accepting unfavorable terms could hurt the program's financial viability, limit data access, or restrict operational flexibility.
  • Inadequate risk management framework: Failure to identify or address potential legal, contractual, and operational risks could lead to unexpected issues, compliance failures, and financial losses.
Team:
  • Manage Delivery Management activities at the Delivery and program level.
  • Drive/ Lead the planning of internal activities.
  • Mentor and coach junior members of the team.

Qualification and Experience
  • B. Juris / BA Law / B. Proc / LLB / BCom / Other commercial degree.
  • Certificate in Compliance Management
  • PG Diploma in Compliance Management / PG Diploma in Financial Planning (advantageous)
  • Meet the FAIS Fit & Proper requirements to be a FSCA registered Compliance Officer (Cat I)
  • 10 plus years of Experience
