You will report to the senior legal counsel.The role presents an opportunity to work in a professional and dynamic environment, advising the company and its high-profile clients on sophisticated global fiduciary solutions in relation to the company's offshore products and platforms. This role is a senior level role based in Cape Town, focused on supporting the company's product development and retail sales efforts in respect of the company's offshore retail products and the investment into these products by investors resident in South African, as well as non-residents with links to South Africa. The role will provide an opportunity to work directly with the company's retail sales and advisor support teams and also the company's legal team. It also offers an ability to work with experienced team members that are industry specialists across a variety of areas.   • You will be required to provide expert input and advice on the implications of international tax law, exchange control, estate and succession planning, probate and local and offshore wills on the company's retail offshore product offering;
  • You will be required to have deep technical expertise in global fiduciary structures, tax efficiency strategies, compliance with exchange control regulations, global probate rules and the administration of estates with cross-border assets;
  • The ideal candidate will form part of the company's retail/adviser sales team and will work closely with financial advisors, high-net-worth individuals (HNWIs), families, corporate entities, and legal professionals to ensure that the company offers appropriately tailored solutions to its investors;
  • Fiduciary services:
  • You will be required to provide fiduciary input in respect of the company's offshore products;
  • Offshore investing:
  • You will be required to support the company's sales efforts to increase opportunities for South Africans and their families and beneficiaries to invest in the company's international platforms and products;
  • You will be required to utilise your knowledge of offshore financial products, vehicles, regulations, tax, probate, exchange control and estate planning to advise on the impact and implications for investors in the company's offshore products;
  • International tax & exchange control advisory:
  • You will be required to provide technical expertise and input on international tax laws and their impact on investors in the company's retail products;
  • You will be required to advise on exchange control regulations, including cross-border asset transfers, emigration and repatriation of funds;
  • You will be required to liaise with regulatory authorities such as the South African Reserve Bank (SARB) on exchange control matters and the South African Revenue Service (SARS) on tax matters;
  • You will be required to ensure that the company develops and implements solutions and products that meet the tax and exchange control requirements of the clients;
  • Global / cross-border wills, estate & succession planning:
  • You will be required to ensure that the company develops and implements solutions and products which are consistent with estate planning strategies of its clients (particularly those with international assets and beneficiaries);
  • You will be required to provide guidance on trusts (both locally and offshore), their administration and their tax implications;
  • You will be required to assess intergenerational wealth transfer plans, considering jurisdiction-specific inheritance laws;
  • You will be responsible for advising on the implications of investors' local and offshore wills, ensuring compliance with the laws of the relevant jurisdictions;
  • You will be required to advise on conflict-of-law issues and mitigate risks of estate litigation;
  • You will be required to coordinate with offshore fiduciary service providers to align estate planning objectives;
  • Regulatory compliance & risk management:
  • You will be required to stay updated on global tax, exchange control and fiduciary law developments;
  • You will be required to ensure compliance with local and international regulatory requirements (e.g. FATCA, CRS, OECD guidelines and rules for marketing financial products in various jurisdictions);
  • You will be required to advise on global marketing and distribution rules and regulations for financial products - particularly in respect of offshore platforms and financial products and how these can be distributed, advised, sold in various countries;
  • You will be required to assist in risk mitigation strategies and setting parameters for marketing and selling the company's products into foreign jurisdictions;
  • You will be required to provide advice on the selling of offshore products into South Africa, as well as in other jurisdictions;
  • You will be required to analyse the impact of new / amended legislation that will affect the company's retail business and ensuring that we comply with legislation;
  • You will be required to Interpret and apply legislation and regulation applicable to the company's retail products;
  • Client relationship management:
  • You will be required to provide high-quality, client-centric advisory services tailored to the company's products and clients;
  • You will be required to build and maintain strong relationships with clients, legal professionals and financial advisors;
  • You will be responsible for resolving client queries and complaints;
  • You will be required to answer and track legal retail queries received from internal sales teams as well as external financial advisors;
  • xc2xb7 Product development:
  • You will be required to provide legal and fiduciary input on the company's retail products, platforms, transaction forms and terms documents;
  • Engaging and overseeing external advisers:
  • You will be required to collaborate with external legal and financial professionals to ensure that appropriate input and advice is obtained and costs are managed;

CORE QUALIFICATIONS AND EXPERIENCE:
  • You have a LLB as a minimum qualification;
  • You have additional qualifications in tax, financial planning, or fiduciary services
  • You are a qualified lawyer with a minimum of 7 years current, relevant post qualification experience in the financial services industry, fiduciary services, international tax law and estate planning;
  • You are ideally licenced to give advice under FAIS;
  • You have strong knowledge of offshore investing regulations, international tax regulations, exchange control laws, international probate and cross-border estate planning;
  • You have working knowledge of the asset management industry and savings and retirement fund products;
  • You are able to advise on local and offshore wills and global estate administration;
  • You are familiar with global trust structures and their tax implications;
  • You have knowledge of South African and international regulatory frameworks affecting financial products and fiduciary planning.
