DIVISIONAL MANAGER (GRADE 4) ADVOCACY DIVISION
A starting annual total cost to company package of R 1 978 499,77 (negotiable commensurate with experience)
Please note this position is available on a five-year fixed term contract.
Introduction:
The Competition Commission (Commission) is a statutory body constituted in terms of the Competition Act, No. 89 of 1998 (the Act). It is one of three independent competition regulatory authorities established in terms of the Act, with the other two being the Competition Tribunal and the Competition Appeal Court. The Commission is empowered by the Competition Act to investigate, control and evaluate restrictive business practices, abuse of dominant positions, mergers, undertake market inquiries and advocacy in order to achieve equity and efficiency in the South African economy. The Commission is a public entity listed in schedule 3A of the Public Finance Management Act (PFMA) and acts in compliance with section 217 of the Constitution of South Africa.
The Division:
The Advocacy Division at the Competition Commission South Africa ("Commission") is responsible for the promotion of competition through non-enforcement means. It focuses on ensuring a pro-competition legislative, policy and regulatory environment, promoting awareness of compliance with the Competition Act and resolving competition concerns through non enforcement means.
The Role:
The Divisional Manager, reporting to the Commissioner, is a member of the Executive Committee of the Commission and part of the Commission's strategic leadership team. The successful candidate must be able to operate at a strategic level within and outside the Commission, influencing leaders in government and business on adopting pro-competitive business practices. The role includes the strategic oversight of screening, ensuring effective complaint classification and resolution, aligning with strategic priorities, and fostering collaboration with enforcement Divisions. The Divisional Manager engages with key stakeholders in organised labour and other strategic partners in competition regulation both across the continent and globally.
Key Accountabilities:
The main responsibilities of the incumbent will, inter alia, include:

  • Strategy Development

  • Legislative and Regulatory Impact Assessment
  • Public Sector and Private Sector Interface
  • Implement Screening Strategy
  • A minimum of a relevant Master's Degree in Economics, Law or equivalent.
  • Preference will be given to candidates with executive leadership training and experience in competition law, economic policy, or stakeholder relations.
  • A minimum of 10 years related working experience with 6 years' experience working at executive management level.
  • Demonstrated experience in contributing to the formulation and development of public policy (e.g., white papers, policy submissions, legislative inputs).
  • Track record in stakeholder engagement and in managing complex multi-stakeholder projects (e.g., cross-sector initiatives, inter-agency collaborations).
  • Demonstrated experience in engaging and negotiating at an executive level with public and private sector stakeholders.
  • Extensive experience in leading high-level strategic stakeholder engagements with policymakers, regulatory authorities, business leaders, and international organisations.
  • Experience in leading or overseeing screening or case classification processes in a regulatory or enforcement environment will be a strong advantage.
Other considerations and added advantage:
  • Practical work exposure to area of expertise will be further considered to balance against other requirements.
  • International and Multilateral Experience - experience representing institutions in global policy discussions (e.g. AU, SADC, OECD)
  • Extensive experience in implementing transformation projects - the role requires a candidate who has designed and implemented policies driving market transformation, particularly projects promoting the entry and growth of SMMEs in markets and supporting growth and participation of firms owned by HDPs.
